Este estudo analisa as implicações das restrições à interpretação do conceito de fundada suspeita no que se refere às abordagens policiais militares tendo como instrumento as buscas pessoais, sob a percepção de militares do estado da Paraíba lotados na 1ª Área Integrada de Segurança Pública - 1ª AISP, que compreende parte do município de João Pessoa. Utilizando metodologia qualiquantitativa, foram investigadas as percepções de 121 policiais militares sobre a prática da abordagem policial e da busca pessoal, além disso, os critérios para suas realizações e os efeitos das recentes decisões dos tribunais superiores a respeito da fundada suspeita. Os resultados indicam que, embora as abordagens sejam percebidas como fundamentais para a prevenção e repressão da criminalidade, há uma forte percepção de insegurança jurídica e redução da frequência dessas intervenções, sugerindo a necessidade de normatização de procedimentos e capacitação contínua, a fim de conciliar a efetividade policial militar com o respeito aos direitos fundamentais.

This study analyzes the implications of restrictions on the interpretation of the concept of well founded suspicion in relation to military police stops using personal searches as an instrument, from the perspective of military personnel from the state of Paraíba assigned to the 1st Integrated Public Security Area - 1st AISP, which includes part of the municipality of João Pessoa. Using a qualitative and quantitative methodology, the perceptions of 121 military police officers regarding the practice of police stops and personal searches, in addition, the criteria for their implementation and the effects of recent decisions by higher courts regarding well-founded suspicion were investigated. The results indicate that, although stops are perceived as fundamental for the prevention and repression of crime, there is a strong perception of legal uncertainty and a reduction in the frequency of these interventions, suggesting the need for standardization of procedures and ongoing training in order to reconcile military police effectiveness with respect for fundamental rights.
