O TERMO CIRCUNSTANCIADO DE OCORRÊNCIA NAS POLÍCIAS MILITARES BRASILEIRAS: ANÁLISE DAS EXPERIÊNCIAS ESTADUAIS E DOS DESAFIOS DE IMPLEMENTAÇÃO NO INTERIOR DA PARAÍBA

Resumo
O Termo Circunstanciado de Ocorrência (TCO) foi instituído pela Lei no 9.099/1995 como mecanismo destinado ao processamento simplificado das infrações penais de menor potencial ofensivo, buscando conferir maior celeridade, informalidade e eficiência à atuação do sistema de justiça criminal. Ao longo dos anos, a possibilidade de sua lavratura pelas Polícias Militares passou a ser objeto de debates jurídicos, doutrinários e institucionais, especialmente em razão das atribuições constitucionais dos órgãos de segurança pública. Diante desse contexto, o presente estudo teve como objetivo analisar os fundamentos jurídicos da lavratura do TCO pelas Polícias Militares e discutir os desafios e potencialidades para a ampliação do procedimento no interior do estado da Paraíba. Para isso, realizamos uma pesquisa bibliográfica e documental, baseada na análise de legislação, decisões judiciais, dissertações, artigos científicos e documentos institucionais relacionados ao tema. Também examinamos experiências desenvolvidas em estados como Goiás, Minas Gerais, Paraná, Amazonas e Alagoas, buscando identificar aspectos que contribuíram para a implementação e consolidação do procedimento. Os resultados demonstram que a expansão do TCO está associada à redução do tempo de atendimento das ocorrências, à otimização do emprego do efetivo policial e ao fortalecimento do acesso da população aos mecanismos de justiça. Por outro lado, foram identificados desafios relacionados à capacitação continuada dos policiais militares, às limitações logísticas existentes em municípios do interior, à gestão dos materiais apreendidos, à produção de provas técnicas e à necessidade de integração entre as instituições envolvidas. Concluímos que a ampliação do TCO no interior paraibano apresenta viabilidade jurídica e operacional, desde que acompanhada por ações voltadas ao fortalecimento da cooperação institucional, da qualificação profissional e da estrutura necessária para sua execução.
Abstract
The Circumstantiated Term of Occurrence (TCO) was established by Law No. 9,099/1995 as a mechanism for the simplified processing of minor criminal offenses, aiming to provide greater speed, informality, and efficiency to the criminal justice system. Over the years, the possibility of its preparation by Military Police forces has become the subject of legal, doctrinal, and institutional debates, particularly regarding the constitutional responsibilities of public security agencies. In this context, the present study aimed to analyze the legal foundations supporting the preparation of TCOs by Military Police forces and to discuss the challenges and opportunities associated with expanding this procedure in the interior regions of the state of Paraíba, Brazil. To achieve this objective, we conducted a bibliographic and documentary review based on legislation, judicial decisions, dissertations, scientific articles, and institutional documents related to the subject. We also examined experiences developed in the states of Goiás, Minas Gerais, Paraná, Amazonas, and Alagoas, seeking to identify factors that contributed to the implementation and consolidation of the procedure. The findings indicate that the expansion of the TCO is associated with reduced response times for minor offenses, improved allocation of police personnel, and greater public access to justice mechanisms. However, challenges were identified regarding the continuous training of police officers, logistical limitations in rural municipalities, management of seized materials, production of technical evidence, and institutional coordination among the agencies involved. We conclude that the expansion of the TCO in the interior of Paraíba is both legally and operationally feasible, provided that measures are adopted to strengthen institutional cooperation, professional training, and the infrastructure required for its effective implementation.
