Abstract

The implementation of the Circumstantial Occurrence Report (TCO) within the Military Police of the State of Paraíba represents a significant milestone in the consolidation of a more expeditious, efficient, and compatible criminal justice model with the principles governing the Special Criminal Courts. Although the TCO has been provided for since the enactment of Law No. 9,099/1995 — which establishes the Special Civil and Criminal Courts and assigns to the police authorities the drafting of the report for minor offenses — its execution, until recently, was the exclusive responsibility of the Civil Police in the State of Paraíba. Based on the Judicial Decision issued in the Public Civil Action No. 0833164-37.2023.8.15.2001, filed by the Public Prosecutor's Office of Paraíba, the immediate adoption of the necessary measures was ordered so that the Military Police of Paraíba would begin drafting the TCO, in accordance with art. 69 of Law No. 9,099/95. This determination imposed a 90-day deadline for the gradual and full implementation of the measure throughout the state, culminating in the effective expansion of the Corporation's responsibilities, especially under the coordination of the Military Police Inspectorate, with technical and statistical support from the Integrated Command and Control Center (CICC). It is important to highlight that this judicial determination was not inconsistent with the current legal system. State Complementary Law No. 212/2025, in its article 4, item XXVI, already conferred upon the Military Police the competence to "subsidiarily draw up the Circumstantial Occurrence Report", in accordance with federal legislation. Furthermore, the Supreme Federal Court, in the judgment of Direct Action of Unconstitutionality (ADI) No. 5637/MG, established a consolidated understanding that the drafting of a TCO (Terms of Circumstantial Occurrence) by military police officers is constitutional, provided that legal limits are observed and the fundamental guarantees of the citizen are respected. Thus, the recent implementation of the TCO by the Military Police of Paraíba represents not only a procedural innovation, but an institutional readjustment based on legality, administrative efficiency, and the pursuit of economy and rationalization of operational resources. However, the process brings with it significant challenges, involving structural, logistical, technical training, and integration aspects between public security agencies, especially with regard to the harmonization of flows between the Military and Civil Police. From this perspective, the present study proposes to analyze the drafting of Circumstantial Occurrence Reports (TCOs) within the Military Police of Paraíba, evaluating their practical viability, their impacts on cost-effectiveness and the use of operational resources, as well as the institutional implications arising from the recent expansion of this function.
